Removal/Deportation Defense & Appeals

An order of removal is a decision by an immigration judge that a foreign national should be deported from, or prohibited admission to, the United States.  The Gambacorta Law Office, LLC recognizes that effective representation in removal proceedings is imperative given the limited number of opportunities a foreign national has in order to prove that he or she is not removable.  Moreover, the consequences of an order of removal can be severe, including the separation of family and loved ones for years.

An adverse removal order by an immigration judge may be challenged by appealing the decision to a higher court.  The next higher court, if an immigration judge issued the order of removal, is the Board of Immigration Appeals.  If the Board of Immigration appeals upholds the removal order, then judicial review is most often sought from the United States Court of Appeals.  The preparation and drafting of appeals to these higher courts require the researching of legal issues as well as well-crafted argument outlining the bases for appeal and why the facts of your case merit a favorable decision.
